“The Lost Language Of Privacy” by David Brooks (TIMES, 4/14/15)

“During a trial, if a crime isn’t captured on the tape, it will be presumed to never have happened,” is a pessimistic view of the American legal system worthy of moderate conservative David Brooks.

Of course, there will be arrests made when the camera is not working. If the police officers making the arrest do their jobs properly, the legal system will continue to function…the “old fashioned way.”

This is another bit of obfuscating by a journalist well-versed in the practice.
